JEP declares the crimes for the murder of 9 councilors from Rivera, Huila not amnestiable

Bogotá, November 21, 2023_RAM_The Amnesty or Pardon Chamber of the Special Jurisdiction for Peace declared as non-amnestiable the crimes of aggravated homicide, attempted aggravated homicide and personal injuries committed on February 27, 2006 against nine councilors of Rivera, Huila.

Let us remember that this massacre was carried out by the Teófilo Forero Mobile Column of the then Farc whose purpose was to destabilize the municipal governments and make their presence and power known, two weeks before the 2006 Colombian legislative elections.

For these events, the former FARC combatant Clinio Gasca Valderrama was convicted, and in the ordinary justice system he received a de jure amnesty for the crime of rebellion for which he was convicted.

But now that the JEP declared the crimes of aggravated homicide, attempted aggravated homicide and personal injuries as non-amnestiable, this former Farc will not receive any benefits because for the Special Jurisdiction for Peace he committed serious violations of Human Rights or infractions of international humanitarian law. Due to their seriousness, they cannot be subject to amnesty or pardon and the State has the obligation to investigate them, try them and punish those responsible.

For these reasons, Clinio Gasca Valderrama’s file will be sent to macro-case 10, which investigates non-amnestiable crimes committed by members of the extinct FARC guerrilla.
