“We have to find a way to make Justice more equitable” – Comercio y Justicia

Matías Etrat, new president of FeCAcor, warned about the differences in resources between the city headquarters of the Capital and the interior. In that sense, he pointed out the need to expand orality to all venues and jurisdictions in the interior of the province.

The Federation of Bar Associations of Córdoba (FeCAcor) renewed its authorities, resulting in Matías Etrat, from the Villa Dolores Bar Association, as the new president.

Etrat will preside over the Federation that brings together eleven bar associations in the province of Córdoba for a period of two years. After the inauguration ceremony, which took place this Friday at the Faculty of Law of the National University of Córdoba, Etrat spoke with Commerce and Justice.

-As the new president of FeCAcor, what projects do you intend to promote in your management?

– There are many issues on which we are going to work. On the one hand, we want to rfloat an agreement with the Legislature of Córdoba -as it existed at some point- to notify us of any project that has an impact on the profession. This will allow us to express our position when the initiative involves lawyers and the practice of the profession. On the other hand, We want to collaborate in improving the administration of justice: There are many operational issues that need to be worked on and others linked to the Case Administration System (SAC).

Regarding initiatives, We want to reinvigorate the license project for lawyers in the Unicameral. AND within the work proposals also there is the defense of professional duties, We have talked about this with FACA, to work accordingly on these issues. There is a lot of movement in Congress, there is talk of notarial successions, of administrative divorce, there are a series of projects that require the voices of lawyers to be heard.

-There is a constant demand from lawyers for the regulation of fees. Do you plan to work in that direction?

-Yes, the idea is to work with an observatory to analyze failures that are piercing the minimums. We are analyzing changes that can be introduce to the Tariff Code, we believe that work must be done there because times have changed. Many times we notice that the minimum or the average scale is regulated, never the highest, we are always closer to the minimum and it has even been perforated; We have to work on that, and it is a joint effort, not only with the Legislature but also with the Judiciary, because it is the judges who resolve this issue.

– Was the operation of the Medical Commissions in the provincial interior regularized?

– We have to work together with the Ministry of Labor on this issue. The situation varies depending on the venue, in some there are delays, with complaints from those enrolled, I think this needs to be strengthened.

– Are you concerned about judicial delays? How do you see this issue in the interior courts?

– I think that both the Judiciary and the schools are an issue that always worries us. We want agile, faster justice. Orality comes to accompany that, but I also think that Orality must now be provided with infrastructure and resources. We want it to be applicable in all jurisdictions. We have labor orality that is not applied throughout the interior, so we have labor trials in the Capital that are resolved in a short time – two or three months – and, in other jurisdictions such as Villa Dolores -, the same process takes years. We have to find a way to make justice more equitable. There is a lot of difference between the Capital and the interior. It becomes difficult for those registered to explain to customers that the delay is different inside. It is something to work on, I think it is possible, orality is being applied gradually, we will have to see what deadlines the Judiciary foresees for this gradualness and, based on that, present proposals.

– How is the issue of filling vacancies in the courts?There are vacancies but what is being requested is the creation of positions, the vacancies are quite oiled. I have seen more pro-secretaries, that serves to speed up the processes but I believe that the creation of more courts is necessary. We have entrusted each president of the Bar Associations with an x-ray of their constituency to see what are the urgent issues to be addressed because each one has the reality of it. At FeCAcor we want to draw a map and make a proposal all together, we believe that it is the way to work, collectively to make management more effective. Try to make visible everything that is problematic and accompany it with a proposal for a solution, that will be our mechanism, not only the complaint, but a proposal to improve.
