After it became known that the Fifth Municipal Criminal Court denied the action filed by the mayor of Cúcuta, Jorge Acevedo, for an alleged violation of his fundamental rights to good name, honor and rectification of information, after the disclosure of a millionaire debt that he would have acquired during the campaign and for which a court ordered it to be seized; The plaintiff lawyer announced that he would file a request for investigation with the National Electoral Council for not reporting those monies.

“On Monday (today) we will be filing with the National Electoral Council the investigation request for allegedly not reporting money to Cuentas Claras in the campaign for the mayor of San José de Cúcuta so that this body is competent to determine whether they were reported or not. these monies,” said the lawsuit’s lawyer, José Botello. Regarding this, La Opinión reviewed the CNE’s Clear Accounts application, which is where candidates must report the income and expenses of the electoral campaign and, in addition to the fact that the name of Ever Javier Arias Ibarra does not appear anywhere, there are only reported $628,460,291; a figure much lower than what this wealthy lender would have given him.

This story that has Jorge Acevedo under the microscope began when a bill of exchange was disclosed through social networks in which this debt of 1,000 million pesos that Ever Javier Arias Ibarra allegedly lent to the current mayor to finance was established. his electoral career.

Given this situation, the Fifth Civil Court of the Cúcuta Circuit ordered the seizure of the mayor for $1.6 billion.

Jorge Acevedo insisted that this alleged bill of exchange is false and filed a protection action, in which he even linked several media outlets for reporting on the court’s ruling, arguing that they were violating his fundamental rights to good name and honor. .

However, on April 27, the Fifth Municipal Criminal Court denied the action filed by the municipal president. La Opinión tried to collect the version of the first municipal authority, but it was not possible to obtain answers. The plaintiff’s lawyer José Botello celebrated the declaration of inadmissibility of the appeal filed by the mayor and described it as proof that his fundamental rights were never violated.

Prosecutor’s investigation

In the ruling of the Fifth Municipal Criminal Court, they also request that copies be certified to the Prosecutor’s Office and the Judicial Disciplinary Sectional Commission of Norte de Santander so that they can investigate whether a crime or disciplinary offense was incurred with the leak of the process.

The lawyer reported that he would challenge that ruling as he did not agree with the judge requesting an investigation by the Prosecutor’s Office and the Disciplinary Commission.

“I do not agree that they certify copies either to the Prosecutor’s Office or to the discipline to investigate, because if it was possible to demonstrate that the honor and good name of the mayor was not violated, then it is not relevant to certify those copies either. That information was not leaked by the defense or by my client, but rather there is a platform of the judicial branch that is public and anyone can enter,” Botello said.

For Botello, this action seeks to force him to abandon the case of his client, Ever Javier Arias Ibarra.

“They want to constrain me so that I become filled with fear and not continue with the process. I also want to say that I have received threats of different kinds so that I do not continue doing my work,” said Botello.

What’s next?

The lawsuit emphasized that the seizure process for the $1 billion debt continued regularly.

“The process continues in a normal manner where he (mayor) has the opportunity to answer the lawsuit. He rushed out to say that the lyrics were false. After that, I had the rigorous tests done, which are the fingerprint test, and it came out 100% real through the qualified expert,” the lawyer insisted.

Regarding this, Botello provided this media with a fingerprint test in which, supposedly, he confirmed that it would be the mayor’s fingerprint.

This has not been the only investigation in which the mayor of Cúcuta is involved.

Recently, the Attorney General’s Office announced that it would investigate the mayor for alleged abandonment of his position, after the trip to Europe in which there is still no clarity about what happened in that commission.
