The 186 Judicial Attorney I for Administrative Affairs of Quibdó promoted a protection action in favor of the fundamental rights of the Community Council of the Baudó River and its tributaries (Acaba), because a simultaneous election of two legal representatives of the Community Council was presented, maintaining that this controversy had to be defined by the traditional authority designated by the General Assembly in the Internal Regulations that they adopted, that is, the Council of Elders, and not by the Mayor of the Municipality of Medio Baudó and the Director of Affairs for Black, Afro-Colombian, Raizales Communities and Palenqueras of the Ministry of the Interior.

The guardianship judge, through a second instance ruling, found it proven that the mayor of the Municipality of Medio Baudó and the director of Affairs for Black, Afro-Colombian, Raizales and Palenqueras Communities of the Ministry of the Interior violated the rights to ethnic and cultural diversity and integrity of the General Community Council of the Baudó River and its tributaries “Acaba”, especially the constitutional guarantee of self-determination.

As a consequence of the above, the Third Section of the Council of State revoked the decision that had denied the protection, annulled some administrative actions and ordered the director of Affairs for Black, Afro-Colombian, Raizales and Palenqueras Communities of the Ministry of the Interior and the mayor of the Municipality of Medio Baudó that, within a period of forty-eight (48) hours from the notification of the ruling, send the administrative file to the Council of Elders of the General Community Council of the Baudó River and its tributaries “Acaba”, in order to resolve the internal conflict that arose on the occasion of the 2022 General Assembly.
