The Supreme Court definitively disassociated the prosecutor Carlos Stornelli of two files in which he was investigated for the illegal actions of the false lawyer Marcelo D’Alessio.

The main cause is the complaint by agricultural businessman Pedro Etchebest at the beginning of 2019, in which Stornelli was charged for his contacts with D’Alessio,

The false lawyer even took Etchebest to Pinamar for an alleged meeting with the prosecutor to “agree” on the terms by which he would be favored in a derivation of the Cuadernos Case.

The Court did not rule on the merits of the matter but rather rejected an appeal from the Financial Information Unit (UIF) for formal reasons during the government of Alberto Fernández against a ruling by the Federal Chamber that turned the accusation against Stornelli.

“The appellant has not complied with the requirements established in article 7, paragraph c, of the regulations approved by the agreed 4/2007, so it is appropriate to dismiss the present complaint,” the judges held. Horacio Rosatti, Juan Carlos Maqueda and Ricardo Lorenzetti.

Carlos Rosenkrantz excused himself from intervening in the file.

Article 7, section C of the Court’s regulations establishes that “the document filing the complaint must be accompanied by simple, clearly legible copies of (…) the document answering the transfer provided for in article 257 of the Procedural Code. Civil and Commercial of the Nation”.

Due to the lack of that photocopy, the court decided to “dismiss the complaint.” presented by the FIU.

The other case that the highest court closed was the complaint of the dismissed and convicted former federal judge of Corrientes Vicente Soto Dávila, for allegedly creating a case to remove him from office.

Soto Dávila had accused Stornelli and other defendants of the crimes of illicit association, malfeasance, failure to comply with the duties of a public official, aggravated false testimony, failure to report, aggravated concealment and ideological falsehood.

In that case, the Court applied article 280 of the Civil and Commercial Procedure Code and, in two paragraphs, declared “inadmissible” the last proposal of the former Corrientes judge.
