They seek to reverse the sentence of three years of conditional execution for the crime of simple sexual abuse of Deputy Commissioner Gilberto Olivares. The convicted man was sentenced by Justice at the end of February for sexually abusing a San Juan Police agent with whom he shared a Christmas guard, in a sentry box in the Stotac neighborhood, in Rivadavia. The request was made at noon this Friday by his defense before the head of the Fourth Court of Instruction, Martín Heredia Zaldo.

During the hearing, the technical defense presented a specific request for acquittal for Olivares, through an appeal to challenge the sentence that had been handed down by Judge Celia Maldonado de Álvarez. Meanwhile, the Impeachment Prosecutor, Fabrizio Medici, rejected the appeal presented by the defense and asked to confirm the conviction.

It should be noted that Olivares ended up being guilty of the crime of simple aggravated sexual abuse, for being committed by a police officer in the exercise of his duties. For this reason, he is serving his sentence outside of prison.

After listening to both parties, this Friday’s hearing concluded without a final decision, and now Judge Heredia Zaldo is expected to evaluate the arguments presented to make a determination within the next 30 days. That is, he must ratify or rectify the current sentence.

The case

The complaint for which Olivares ended up being convicted was filed by the victim on December 28, 2022 at the UFI Cavig. According to the complaint, Olivares was her boss and in the early morning of December 25, 2022, she was a newly hired clerk in a booth in the Stotac neighborhood. At that moment, Olivares entered the place and she greeted him saying: “Merry Christmas boss.”

Next, Olivares hugged the victim, immobilizing his arms, massaged his back and then touched his tail. Faced with this attitude, the woman defended herself by pushing Olivares and he responded by touching her breasts. The agent got upset and she let him know: “I didn’t do anything to make him disrespect me,” she reproached him. At the same time, she informed him that she was not going to remain silent and would inform her superiors of the situation. The police chief was not concerned, and even provocatively responded that she had better leave, “if not, I’m going to end up sending her away.” And she said goodbye, ordering him, as a punishment, that she would also stand guard on the 25th at night.

The young victim spent a very distressing night and the next day as well, as she feared that the deputy commissioner would return to look for her at the surveillance post. The night of December 25 and the early morning of December 26 were extremely difficult for the girl, who told a classmate about the violent episode that she experienced with Olivares, according to her. As the hours passed and thanks to the support of one of her colleagues, the agent was able to file the complaint against Olivares.
