José Mosquera filed a lawsuit in order to protect his fundamental rights to human dignity, due process and petition, This is because in the year 2023 I ask the Attorney General to intervene, so that the Minister of the Interior and the governor of Chocó Ariel Palacios abide by and respect the court order and, in turn, conduct a disciplinary investigation into their conduct as public officials.

However To date there has been no response on this issue.

And the plaintiff assures that the Minister of the Interior, Luis Fernando Velasco “does not exercise administrative surveillance to monitor whats administrative processes as a hierarchical superior to resolve the crisis of ungovernability in Chocó and there is not the slightest interest in solving the underlying problem”says the ruling.

On the other hand, he stated that the Legal Office of the Ministry of the Interior issued legal concepts on the problem in question, “when what is intended is to highlight the administrative act that ordered the reinstatement of Mr. Ariel Palacios Calderón to the position of governor of the Chocó, an act that must be signed by the President of the Republic and the Minister of the Interiorr, since it is the responsibility of the latter to issue administrative acts or sign official letters and, within the framework of the law on access to information and transparency, make them known to society because it is a matter of interest to the Chocoano people.”

Thus, and with the objective of achieving effective compliance with the guardianship order pending execution, the Council of State opened the incident of contempt presented by José against the Minister of the Interior, but he granted him a period of 3 days to report on compliance with the guardianship order.
