Law 166 of 2023 On the Military Prosecutor’s Office, approved by the deputies in the Second Ordinary Session of the National Assembly of People’s Power, in its X Legislature, on December 22, 2023, was published in the Official Gazette of the Republic in its ordinary edition No. 43.

This legal norm regulates the organization, functions and structure of the Military Prosecutor’s Office, as well as the election, appointment, revocation and responsibility of military prosecutors.

In the presentation of the document before the deputies, Yamila Peña Ojeda, attorney general of the Republic, explained that its construction is the result of collective work, enriched in the exchanges and consultations with bodies, organizations and entities, as well as the determined contribution of the deputies.

He added that its implementation is complemented by the Regulations and internal work procedures, and contains the modifications included in the Constitution and Law No. 160 of 2022, Of the Attorney General’s Office of the Republic.

Furthermore, it ratified that the Military Prosecutor’s Office is an organ of the Attorney General’s Office of the Republic, with hierarchical and functional independence, and subordinate to the Attorney General.

The legislation identifies the guiding principles that govern its activity, determines the scope of action to guarantee the fulfillment of the mission, perfects the objectives and functions, in accordance with the constitutional mandate and the judicial, procedural and legislative reform.

In addition, it ensures legal support for the powers of the Deputy Attorney General, Head of the Military Prosecutor’s Office and relates those of the prosecutors within the processes in which they perform; It establishes the duties and rights, the protection and guarantee of the position, places ethical conduct and good practices in a predominant place, which elevate the prestige and social recognition of the profession to higher levels.

This rule will come into force 60 days after its publication in the Official Gazette.
