The Appeals Chamber of the High Court of Justice of Catalonia has denied amnesty to a person who is convicted of attacking an authority figure. Specifically, it concerns a young man who threw a bottle at a Mossos d’Esquadra agent during a drinking party he was holding in Barcelona’s Plaça Catalunya in September 2021.

The court has concluded that these events have nothing to do with the Catalan independence process. Therefore, the amnesty will not be applied to this young man, who will have to serve his sentence.

In the document to which laSexta has had access, the TSJC indicates that it understands that “the factual account does not state that the accused’s actions occurred in the course of acts or protests to show support for the objectives and Ends of the Catalan independence process“.

They also point out that this “would not be an obstacle if the events had actually occurred in this context and within the time period established by law, since the political situation that was taking place in Catalonia at that time is well known, with numerous disturbances in which a large number of people gathered to confront the police in support of the independence process, taking advantage of various public events or acts.”

However, this is not the case. “After examining the police report in detail, we found no reference to the Catalan independence process,” the magistrates said before recalling that the officers who were part of the safety device formed in the early hours of September 25, 2021, in response to the serious disturbances that were taking place in Plaza de España and other areas, was motivated by the fact that “there was a very large concentration of people consuming alcoholic beverages”
