President Javier Miley He is now trying to get the law that bears the name of his favorite dog: ConanThe initiative was a proposal from the national deputy of Pro Damian Arabia and will begin to be discussed this Wednesday in the Lower House, in the Criminal Legislation Committee. The focus is on increasing the penalties for those who commit abuse and animal crueltyas well as establishing fines and classifying new behaviors.

Among the acts that are punishable are, for example, not seeking care. vet animals that are under the responsibility of the individual, leaving them constantly under extreme temperatures, experimenting on animals for the production of cosmetics when there are other ways to do so, performing surgical interventions on animals without a veterinary degree, and more.

Such acts can be punished with imprisonment from six months to five years and a fine of five to thirty times the minimum wage.

On the other hand, anyone who kills an animal through mistreatment or subjects it to sexual abuse will face a prison sentence of two to six years, in addition to a fine of 100 to 200 times the minimum wage.

The president welcomed the initiative by posting an image on his Instagram account comparing the current legislation with the project presented by Saudi Arabia.

  • Anyone who commits mistreatment or makes animals victims of acts of cruelty shall be punished with imprisonment from six months to five years, with a fine of five to thirty times the value of the Minimum Living Wage.
  • The following are considered acts of abuse: failing to feed domestic or captive animals in sufficient quantity and quality; using animals in tasks that exceed their strength, are inappropriate based on their aptitude, physical condition and/or cause them punishment, pain or suffering; failing to seek veterinary medical attention when they are under your responsibility; constantly limiting their mobility in areas whose size or exposure to extreme temperatures, whether cold or intense heat, represent a danger to their health or prevent them from expressing their natural behavior; abandoning an animal under your responsibility on public roads or on public or private property, exposing it to conditions of abandonment, lack of hygiene, lack of food or obvious health problems; and stimulating them with drugs without pursuing therapeutic purposes or that are not authorized by the corresponding health entity.
  • That it is understood as an act of cruelty to practice vivisection on any animal; to surgically intervene on animals without anesthesia or without possessing a medical degree or veterinarianexcept in the case of duly proven urgency; experimenting on animals for the production of cosmetics and/or ingredients used in the cosmetology sector; experimenting on animals when other forms of scientific and extension research exist and it is not strictly necessary to do so, when the results sought have been obtained through previous practices and/or when the essential standards of animal ethics or bioethics are not met, or when a protocol guaranteeing the ethical and safe use of animals approved by a competent authority is not met; intentionally hurting or running over animals; and carrying out, facilitating or actively participating in public or private acts of animal fights, bullfights, dog races, bullfights, parodies and rituals in which animals are killed, injured or harassed.
  • Anyone who kills an animal through mistreatment, making it a victim of acts of cruelty or out of mere perversity, shall be punished with imprisonment of two to six years and a fine of 100 to 200 times the minimum living wage. “The same penalty shall apply to anyone who abuses or facilitates the sexual abuse of an animal through carnal access or impalement; to anyone who tortures or causes suffering or who mutilates any part of the body. Mutilation shall not be punishable when carried out for strict health or pity reasons,” the article clarifies.
  • In addition to the sentence for these cases of mistreatment, cruelty or death, the additional penalty is special disqualification for the possession of animals and the impossibility of exercising any type of contact with them. “The period of disqualification will be defined by the judge in charge and will not be less than double the period of the sentence for acts of mistreatment or cruelty, while for those who kill an animal it must be life,” the law indicates.
  • For the crimes contemplated in the bill, the judge in charge must adopt, from the beginning of the judicial proceedings, sufficient precautionary measures to ensure the rescue of the victim animal, when its owner was directly or indirectly linked to the commission of the crime, for its comprehensive protection. Likewise, the magistrate must order the delivery of the victim animal into custody to public entities, persons or private entities dedicated to the protection of animals that have shelters and are legally registered. “The expenses incurred by the custody of the victim animal in the care of whomever the judge defines will be compensated,” the text states.
