The Civil and Criminal Chamber of the High Court of Justice of Catalonia has granted amnesty to CMS, who was secretary of the Town Hall of Hostalric (Girona), who was convicted of a crime of prevarication to the penalty of 9 years of special disqualification from holding public office for “exaggerating” the actions of a group of people who went to the town to remove yellow ribbons and banners in support of the independence process. The TSJC annuls the sentence that condemned him, considering that “with the purpose of warning and punishing these people who went to the town of Hostalric, fully aware that the acts attributed to them were not punishable, he gave them a false typicality by temporarily decontextualizing them and insidiously exaggerating them by adding references to non-existent threats and intimidation or directly falsifying them to achieve their punishment.” In a second resolution, the TSJC has extinguished the criminal liability of EBDA, convicted of possession of explosive devices for carrying a bottle of hydrochloric acid in a backpack during the demonstration that took place on December 21, 2018 against the holding of the Council of Ministers in the Llotja de Mar building. NO AMNESTY IN THE MERCÈ RIOTS The TSJC has agreed not to amnesty one of those convicted during the riots at the Mercé festivities in Barcelona in 2021, who was arrested at the intersection of Creu Coberta Street and Plaza España for throwing a glass bottle at agents of the Mobile Brigade (BRIMO) of the Mossos d’Esquadra. The court considers that the police report did not contain “any reference to the Catalan independence process”, but that the accused was in an area where a large-scale drinking party had been organised via social media on the occasion of the La Mercé festivities.
