The Comptroller’s Office issued a serious warning regarding the technical and economic risks involved in the resolution on the financing of the Rural Interest Housing program, which allocates subsidies granted to previous beneficiaries to be applied to others; if this measure is applied, there would be a high possibility of affecting the treasury. The warning was addressed to the Ministry of Agriculture and Rural Development, the Agrarian Bank and the Intersectoral Commission for Rural Social Interest Housing.

“The Comptroller’s Office notes a possible violation of the principles of the administrative function and fiscal management, which it considers were not addressed in the issuance of Resolution 490 of 2023 by the Ministry of Agriculture and Rural Development, which if persisted may lead to the violation of fundamental rights of the beneficiaries of the Rural Social Interest Housing Program, in addition to the possible occurrence of a patrimonial detriment,” the Comptroller’s Office issued.

According to the public resources watchdog, to date there is still a real and imminent risk of the application of Resolution 490 of 2023, issued by the Ministry of Agriculture and Rural Development, which leads to the allocation of subsidies granted to beneficiaries, to whom the State recognized their right to decent housing, to be applied to other beneficiaries of the rural social interest housing program, and, on the other hand, the slowdown of the Rural Social Interest Housing Program at the national level.

“With the application of the resolution, which determined to create a cash unit with the unrealized subsidies of the Program, use would be made of subsidies that may be invested in housing under construction, completed and not delivered to the beneficiaries, or in housing that is just about to begin construction, which would impact the financing of housing projects not identified in the resolution of the ministry, which only considered five integral managements of the Rural Social Interest Housing Program.”

This resolution of the Ministry of Agriculture establishes the possibility of recognizing the alleged economic imbalance in the contracts in charge of the five prioritized integral managements, without exhausting the instances determined by the Constitution and the law, on the houses completed before the entry into force of the Law of the National Development Plan 2022-2026, for which an affectation to the public patrimony of 50,653 million pesos could be incurred.

Furthermore, the supervisory body considers that there is a violation of the administrative function, by issuing an administrative act without prior budgetary support and determining the cash unit with resources from different sources and specific destination, contrary to the budgetary regulatory framework, since these are resources with a specific destination.
