The National Consumer Service (Sernac) reported that it approved an administrative opinion related to the modality “Retirement in store”because some companies apply an additional charge to customers opting for this modality.

In the opinion of Sernac, “the companies that sell online and that have physical stores They must necessarily offer a delivery mechanism From products to consumers ”.

In addition, he explained that to its interpretation, when making the purchase of a or the hiring of a service, either, remote or face -to -face, “the consumer must pay the previously informed , not being able to apply an extra charge when there is no additional consideration.”

In this way, the service added, “companies can only make additional charges to the extent that they are complementary to the main and duly informed obligations before the purchase, the consumer being able to accept them or reject them freely, for example, for example, being able to pay for an office at home or opting for free retirement in a specific store. ”

Finally, and in this context, the Sernac said that “the clauses where companies impose the payment of an additional amount tied to the main product or service will be abusive, without the consumer being able to accept it or reject it voluntarily and separately.”
