The Prosecutor’s Office of Malaga has accused four men for its alleged relationship with the preparation or for the collaboration in the murder of another in the capital of Malaga for a possible adjustment of accounts related to drug trafficking. Thus, for the main prosecuted request a penalty of 22 years and seven months in prison.
According to the initial conclusions of the prosecutor, to which Europa Press has had access, this defendant, along with another man who is looking for and capturing, were the ones who would have decided to end the life of the victim, a Congolese citizen resident in a French city, for that reason.
To do this, “they devised a plan in which both acting together would be executed in the city of Malaga where that would be cited by deception,” said said letter, in which it was specified that the man arrived in March 2019 to the Malaga airport from Paris, having used a French passport that was not his.
In order to “ensure the death” of this “without any risk,” says the prosecutor, the aforementioned defendant planned that it would be carried out in the vicinity of the Emasa treatment plant, in the Guadalhorce polygon, organizing the transfer to said “uninhabited” place in rental vehicles.
Aware that could relate them, they requested for this the help of an acquaintance, another of the defendants, who, according to this accusation, “lent to it, not being accredited to know in advance the intentions of those.” This would be, they point out, who would ask for the collaboration of the other two defendants.
According to the Public Ministry, they would be in charge of renting three vehicles, presenting to formalize the contract a false Italian identity letter, and that were transferred to the place designated to give it to the main defendant and the other man who is fled in order to go to pick up the victim.
Thus, these two took the victim to that area of the polygon and after getting out of the vehicle “they shot him with a firearm that used only one of them without being able to realize who, all carried out in the back, thus preventing any type of defense and in order to ensure the deadly result and without any risk for the authors.”
These shots caused death upon reaching it on eleven occasions. They were carried out at a short distance and hit him on the head, neck and trunk, affecting vital structures such as lungs. This produced death, although the death occurred with the last shot “with which he was executed which reached his head when he lay already fallen into the ground.”
After this, they went to Marbella (Málaga) where they left the cars and ordered one of the intermediaries to clean the interior, at which time the three alleged collaborators had knowledge that they had been used for that purpose.
In the records made, false documentation and an electric gun were found. The firearm used to end the life of man has not been recovered.
For these facts, the prosecutor accuses the main prosecuted of the crimes of murder, illicit possession of a firearm, falsehood in official document committed by individual and use authentic identity document, requesting in total 22 years and seven months in prison.
Likewise, the other three are accused of a crime of cover -up, requesting for two of them one year and ten months in jail and for another, one year and eleven months in prison. To this, in addition, he accuses a crime of prohibited weapon possession, so he adds a year and eleven months in jail.
As compensation, the Prosecutor’s Office urges that they indemnify parents with 188,000 euros for moral damages caused by the death of their son.
