The Calama Prosecutor’s Office formally requested the Local Guarantee Court not to persevere in the investigation against 20 Codelco union leaders, linked to the so -called CASE CASE CODELCO.
The state Cuprífera accused them of organizing an alleged fraud with life insurancebut justice determined to close the case due to the absence of evidence.
The Calama Guarantee Court hosted the fiscal petition and convened a hearing for this May 2, where he ratified the definitive dismissal of the complaint against 20 workers belonging to unions 1, 2 and 3 of Chuquicamata and Radomiro Tomic workers. The judicial resolution thus supported the lack of foundations to sustain a formal accusation.
For five years, the Prosecutor’s Office executed proceedings, raids, expert opinions and collected statements without finding a history to support the charges. This probative vacuum consolidated the decision to file the case, marking a setback for Codelco’s legal strategy.
In addition, in April 2022, the Constitutional Court declared unconstitutional the actions of the state company to the try the lawlessness of union leaders.
Complaint of anti -indical practices and repair demands
The prosecutor’s decision is known weeks after unions 1 and 2 of Chuquicamata, together with former leaders, submitted a complaint with a complaint with a complaint for Santiago anti -indical practices and a demand for compensation for damages.
Héctor RocoPresident of the Union No. 1 of Chuquicamata and the Federation of Copper Workers, said that “we were always convinced of this result. Our full innocence would be demonstrated, with the lack of background, that there is no evidence to accuse us of the alleged orchestrated fraud that Codelco repeatedly disclosed by the media, as an advertising campaign.”
He added that “Codelco and the executives who created this trick abused by presenting these complaints and demands. They abused the confidence of their workers, the responsibility of managing the resources of Codelco and the commitment that the leaders have with Codelco and the country.”
Roco also advanced legal actions in October 2024 to compensate damage to unions and dismissed workers.
The legal strategy of the unions is sponsored by the study Rossel, Fuentes and Urzúa (RFU lawyers), the same team that defended the leaders in the case of lawlessness before the Constitutional Court and the Calama Labor Court.
