The government of US President Donald Trump requested the Supreme Court on Thursday that allows him to revoke the legal status of 532,000 migrants from Cuba, Haiti, Nicaragua and Venezuela, which had a permit of temporary permanence, known as Parole.
In March, the Government tried to revoke the legal status of these migrants arrived in the United States under a program launched by the former Democratic President Joe Biden and also called ChNV, by the initials of the countries.
In October 2022, the Democrat’s government granted a permit for a quota from Venezuelans to legally enter, provided that they exceed an investigation into their criminal record, they had a sponsor in the country to provide financial support and be vaccinated.
In January 2023 he extended the measure to Haiti, Cuba and Nicaragua.
The legal advisor of the Administration, John Sauer, requested to raise an order of a lower court that prevents the Government from ending humanitarian protections for migrants from these four countries.
Indira Talwani District Judge, appointed by Democratic President Barack Obama, prevented the government for the legal status of migrants last month.
In his order, Talwani affirmed that the Government makes an erroneous interpretation of the Immigration Law, since accelerated expulsion applies to foreigners who enter illegally in the United States, not those authorized to remain in the country.
With Trump’s revocation, migrants would have lost their legal protection as of April 24, that is, 30 days after the National Security Department published the Order in the Federal Registry.
The Trump government also requested last week to the Supreme Court, of conservative majority, which supports its proposal to end the temporary protection status (TPS), which prevents more than 350,000 Venezuelans from deporting.
On January 10, coinciding with the presidential investiture of Nicolás Maduro in Caracas, the Biden administration prolonged the TPS for 18 months for Venezuelans, from April 3, 2025 until October 2, 2026.
The United States gives TPS to foreigners who cannot return to their country safely due to wars, natural disasters or other “extraordinary” conditions.
In March, the Federal Judge of California Edward Chen temporarily suspended the decision to revoke the TPS for estimating that “it smells like racism.”
Trump campaigned promising millions of migrants in an irregular situation and put all the administration machinery at the service of this objective.
The Republican tycoon even invoked a law of the 18th century, used until then in times of war, to expel alleged Venezuelan gang members to a prison in El Salvador.
