Mayor of Comas is sentenced to six years in effective prison for the crime of aggravated collusion

Ulises Villegascurrent mayor of the district of Comashe was sentenced in the instance to Six years in effective prison (with deferred execution) for the crime of aggravated collusion. The sentence was requested by the office of the Provincial Prosecutor Corporate specialized in crimes of Corruption of officials of Lima Norte, within the framework of a case that dates back to 2017, the burgomaster was a representative of the UDEL Group company.

The case focuses on the of the “Improvement of roads of the Santa Rosa extension and passage from the cross of the San Camilo settlements, San Albino and the steering wheel (SNIP-29876)”, in the District of Independence. According to the Prosecutor’s Office, the company Udel Group, represented by Villegas, He signed agreements with municipal officials to deliver the work even though it was not completed, which would have caused damage to the State.

As if that were not enough, next to the Burgomaster of Comas, Rubén Jiménez (former municipal manager of Independence), Elizabeth Espinoza (former manager of Independence Infrastructure), Pedro Ancajima (Plant Exingenero) and César Cervantes (Expervisor of Work) were sentenced, all as co -authors of the crime of aggravated collusion.

Among the elements of conviction presented by the Prosecutor’s Office are reports from the Comptroller General of the Republic, of the Supervisory Agency for State Hiring (OSCE)Civil Engineering, Accounting, Economy and the Full Technical File of the project. These evidence would aim for coordination among those involved to simulate the culmination of the works and authorize their delivery.

As is known, the figure of the aggravated collusion, according to the Criminal Code of our country, is configured when a public agrees with a contractor to disappoint the State. In this case, Ulises Villegas acted as legal representative of UDEL Group, a company responsible for executing the work.

Although the conviction was already issued, it has not been made effective. The : it is a Judgment of First Instance And, in accordance with legislation, those sentenced have the right to appeal. While the appeal is resolved in a higher instance, the execution of penalties is suspended.

The figure of deferred execution allows sentenced persons not to immediately enter a penitentiary center. Instead, they remain released while deciding whether the conviction will be ratified, modified or revoked.
