Regarding the announcement made by the Fuegian Government, regarding the presentation of an appeal for protection against the gas tariff, OUTDOOR FM consulted official sources about the next steps that should be taken in the field of Federal Justice. They recalled that protections against the State have other procedural deadlines and when the issue is resolved, the application is immediate.

They reported in this regard that the amparos against the State do not have the same procedural deadlines as the amparos that can be presented for people’s health issues, “they are different because they must be transferred to the National State and the State has to respond and not always the resources are the same”, because the deadlines are longer.

Furthermore, it was learned that if a precautionary measure is issued, it is immediately enforceable, regardless of whether it is resisted or appealed in the Chamber. And once the Court of Appeals decides, the situation will be analyzed.

And when the first instance judge resolves the underlying issue, obviously it can also be appealed and the Chamber will decide. “But the precautionary decisions, which are the first, are mandatory at the time they are issued,” said the sources consulted.
