The CNMC (National Commission on Markets and Competition) has imposed a sanction a RTVEafter detecting covert advertising in the broadcast of “Peralada Golf Tournament“on March 9th 2023. During the broadcast, An energy drink was shown along with its logo, His name was mentioned and he was explicitly promoted through a challenge proposed to the tournament players. Therefore, the CMNC has determined that This broadcast violates article 122.3 of the General Law of Audiovisual Communication (LGCA). This law establishes that All advertising sites must be clearly marked. so that viewers can distinguish between informational content and commercial promotion. The lack of proper identification of advertising compromises transparency and viewers’ trust in the content broadcast.

The initial sanction planned for RTVE was 120.000 euros. Nevertheless, This amount has been reduced by 40% due to the express recognition of responsibility by RTVE. and the advance payment of the fine. Thus, the final fine has been lowered to 72.000 euroswhich reflects the public corporation’s willingness to assume its responsibility and comply with regulatory obligations.
