He judgment for the death of Diego Armando Maradona (60) was on the verge of suspension, due to the request of one of the accused to be tried by a popular jury, which was accepted by the San Isidro Court of Criminal Appeals.
The ruling of Chamber II casts doubt on the start of the oral debate that was scheduled for June 4, before the Oral Criminal Court No. 3 of San Isidro.
In the resolution by the majority of the chamber, the judges not only endorsed the request of the accused Gisela Madrid, one of the eight people suspected in the case, but also indicated that there are other defendants who can follow the same path of the judgment popular.
The eight are on trial for the crime of simple homicide with possible intent, with sentences of 8 to 25 years in prison.
“It does not appear from the digital records, corresponding to the main proceedings, that the remaining co-defendants Luciano Leopoldo Luque, Ricardo Omar Almirón, Pedro Pablo Di Spagna and Mariano Ariel Perroni have expressly waived the constitutionally protected guarantee to be tried by a jury court “, is indicated in the ruling, which adds: “As such, their procedural situation – in principle – would be covered by the same normative provisions as those previously analyzed and, unless expressly waived, their process should be processed before juries” .
Nurse Madrid had already requested to be tried under this modality on November 14, 2023, but in that instance the request had been rejected.
Meanwhile, on December 5 of the same year, Martín Miguel De Vargas, another of her defenders, opposed the decision made by the court in writing and requested the jtrial popular, which was now accepted.
It was agreed that the debate, in which some 200 witnesses would testify, would start on June 4 and according to the agenda set by the Oral Criminal Court 3, it was going to take place on Tuesday, Wednesday and Thursday.
Maradona He died at the age of 60 on November 25, 2020, and an autopsy determined that his death occurred as a result of “acute pulmonary edema secondary to exacerbated chronic heart failure,” and he was also found to have “dilated cardiomyopathy.”
