The wife of Otoniel Orozco Mendoza, 53 years old, who was murdered on Monday, June 3, by a neighbor named Ramírez Zamora in the Río Palma condominium, in Guachipelín de Escazú, Costa Rica, He denounced the father of the suspect, identified by the surname Ramírez Reyes, for defamation this Tuesday morning.

However, upon arriving in Costa Rica, Neighbors and acquaintances asked them if the now deceased possessed weapons and made different statements that, apparently, were reported in the media regarding what happened..

“They consulted me about what was happening and what we could do, how the Prosecutor’s Office could help them. Eventually, defamation is not a criminal offense that leads to prison, but rather it is a contravention and is regulated in the Penal Code as offenses to the memory of a deceased. So, she (the wife) made the decision to file the complaint at 10 in the morning,” Ayala told The nation.
The right to prosecute for this crime includes the spouse, children, parents, grandchildren and blood siblings of the deceased.
The crime of offending the memory of a deceased is typified in article 148 of the Costa Rican Penal Code.

The text of the law establishes that “anyone who offends the memory of a dead person with insulting or defamatory expressions will be punished with a fine of ten to fifty days. The right to prosecute for this crime includes the spouse, children, parents, grandchildren and blood siblings of the deceased.”
The deceased was from Matagalpa, Nicaragua, but had lived in Costa Rica for decades and was naturalized.

Who was Otoniel Orozco, the murdered man?
The tragic incident occurred at 7:31 am and, according to first reports, was due to a dispute over drinking water. The Judicial Investigation Organization (OIJ) is in charge of determining the motive for the crime.

Red Cross rescuers arrived at the scene, but Orozco had already died due to several gunshot wounds to the chest, arms, head, back and other parts of the body.

A Costa Rican judge issued preventive detention for Ramírez, who will face a murder trial in approximately a month..
According to Costa Rican media, Ramírez made xenophobic comments against Orozco Mendoza and questioned his residence in a condominium of a certain economic level.

Both men had a history of complaints of attacks, obscene acts and provocations dating back to June 2022, according to investigations by ‘La Teja’.
The Vice President of Nicaragua, Rosario Murillo, reported that Orozco’s body was repatriated and buried in his homeland, Trujillo, municipality of Ciudad Darío. Murillo condemned the crime, attributing it to xenophobia, and called for justice for Orozco’s family.
