Elon Musk has withdrawn his lawsuit against OpenAI and its CEO, Sam Altman, in which the ChatGPT maker was accused of breaching a contract by abandoning its original mission of creating artificial intelligence, AI, for the benefit of humanity.

A US network reported Tuesday that the case was dismissed without prejudice, meaning the CEO of SpaceX and Tesla could refile the lawsuit. No reason was given as to why Musk dropped the case.

The South African-born tycoon, who helped co-found OpenAI in 2015 before leaving the company and launching his own AI company later this year, filed the lawsuit last February. Musk claimed the company had put its founding mission that artificial general intelligence, AGI, would put people ahead of profits, “on fire” when it signed a deal worth billions of dollars with Microsoft.

“To this day, OpenAI, Inc.’s website continues to assert that its goal is to ensure that artificial general intelligence benefits all of humanity,” Elon Musk alleged in the lawsuit.

“In reality, however, OpenAI, Inc. has become a de facto closed-source subsidiary of the world’s largest technology company: Microsoft,” he added.

Within OpenAI they pointed out that Musk’s lawsuit was “artificial” and that there was no founding agreement, and even leaked emails exchanged with the owner of Tesla that countered his claims.

The dismissal of Musk’s lawsuit comes a day before the justices were scheduled to review OpenAI’s request to dismiss the case. In addition, it comes a day after Musk stated that he would prohibit the use of Apple devices in his companies if the American multinational technology company integrates OpenAI technology into its products.
