He Commercial Court No. 12 of Barcelona has admitted to processing a second class action lawsuit against car manufacturers Mercedes, Nissan and Toyota. A lawsuit regarding car cartel casefor which several automobile brands would have illegally inflated the price of their vehiclesthus harming the consumer.

From the Organization of Consumers and Users (OCU) they celebrate this decision, in which it is the second lawsuit of those presented on October 19, 2023 against ten manufacturers and five of their parent companies. The plot extends between the years 2006 and 2013in relation to the new car market.

Said court, after examining the claim and concluding that meets the formal requirements to process ithas admitted the claim and has transferred it to the brands in question so that prepare your response within twenty days. The OCU, since it is a collective action carried out on its initiative, will carry out an appeal to the possible victims, as indicated in the Civil Procedure Law.

Among those possibly affected are those who bought vehicles of different brands for almost a decade: from June 2008 to August 2013 for Nissan brand cars, from March 2010 to February 2011 for the Mercedes brand and from February 2006 to August 2013 for Lexus or Toyota brand cars.

A new claim admitted

The anti-competitive practices of these and other brands led the OCU to present a series of class actions, which in total already amount to six. Four of them have already been admitted for processing. The last one, against manufacturers like Opel, Peugeot, Citroen, Fiat, Alfa Romeo, Lancia, Chrysler, Jeep and Dodge. After these illegal pacts, which harmed thousands of people, The National Markets and Competition Commission sanctioned manufacturers and dealerswhile the Supreme Court confirmed the sanctions for the known “model scam”.

In total, the brands sanctioned are the following: Citroën, Mitsubishi, BMW, Chevrolet, ChryslerFiat, Ford, General Motors, Dodge, Honda, Hyundai, Jeep, Kia, Mazda, Mercedes BenzNissan, Peugeot, Porsche, Renault, Seat, Skoda, Toyota, Volskwagen, Audi, Alfa Romeo, Land Rover, Lancia, Lexus, Opel and Volvo.
