This Monday, April 29, 2024, the San Juan Justice charged Rodolfo Duilio Rosales with fraud, a man from San Juan accused of delivering millionaire checks without funds and false ones in the purchase of a Ford 600 truck and a Mercedes Benz car. Two men denounced him, one even said that he gave him a deferred check from a company, which apparently was adulterated.

On Monday morning, the detention control and formalization hearing against Rosales was held, chaired by the guarantee judge Mario Guillermo Adárvez. The accused, a native of Caucete, arrived at the courtroom, guarded by police. It should be noted that he was detained three days ago after an investigation carried out by prosecutor Pablo Martín came to the conclusion that they were facing two events: issuing of a bottomless check; fraud and use of a forged check, in an ideal contest; both in real competition, as author.

After listening to the parties, on the one hand, the Computer Crimes and Fraud Prosecutor’s Office and on the other Rosales’ defense, Judge Adárvez formalized the accusation against Rosales for the events attributed to him and granted time for the investigation of 10 months. He also granted his release, although he forced him to submit to the investigation.

Therefore, Rosales must appear at the trial as many times as he is summoned and is obliged to appear at the 9th Police Station, once a week for 10 months, depending on the extent of the preparatory criminal investigation.

On the other hand, Rosales is prohibited from leaving the province without requesting prior authorization from the judge and cannot come within a distance of less than 300 meters from wherever he is and from the respective domicile of the complainants.

The facts

Firstly, based on the complaint made by Roberto Ceferino Flores on April 8, 2024, it is revealed that on January 16 of this year, Rosales acquired a white Ford 600 Truck through a payment agreement with deferred checks from Banco Santander. However, upon attempting to use the checks, the complainant discovered that they lacked funds, which led to submitting a document letter with no response until the date of the complaint. Flores received three checks from Rosales as part of payment, of different amounts: $2,000,000, $1,000,000 and $500,000.

On the other hand, on April 24, Mario Federico Bazán filed a criminal complaint against Rosales. According to Bazán, on the 14th of this month, he sold Rosales his Mercedes Benz truck, Vito model, for a value of $10,000,000. As part of the payment, he received a check for $10,000,000 from the company Camino del Oeste SA (Avícola Myriam), which turned out to be false due to a spelling error. After unsuccessful attempts to contact Rosales, Bazán discovered that the check had not been issued by the indicated company.
