Bill No. 171 of 2022 “By means of which the Ranchería River, its basin and tributaries are declared as subject of rights and other provisions are issued.”; It is one debate in the House of Representatives away from becoming a Law of the Republic, which is authored by the Guajira senator Martha Peralta Epieyu but this was presented by the representative to the chamber Ana Monsalve.
This initiative has two main objectives: first, to declare the Ranchería River as a subject of rights. Second, establish real mechanisms of protection, conservation, maintenance and restoration by the State and the ethnic and peasant communities that live in the department of La Guajira, through the creation of the Commission of Guardians of the Ranchería River and the Plan of action of the Ranchería River.

“Today we are happy for the approval of our Bill that seeks to declare the Ranchería River subject to rights, establishing real mechanisms of protection, conservation, maintenance and restoration by the state and the ethnic and peasant communities that inhabit La Guajira. The recognition of the Ranchería River as a subject of rights seeks to ensure that the policies of the Ranchería River have as their primary purpose conservation, restoration (through decontamination, recovery and rehabilitation) and its maintenance. In addition, it is recognized that there will be a mentorship, made up of the Commission of Guardians of the Ranchería River that is created.
It should be noted that, in the debates of the Senate of the Republic, the formation of the Commission based on the Law was proposed, but, in accordance with the considerations of the Prior Consultation Directorate, it was suggested that these actors define the formation of the Commission. Guardian Commission.
It is necessary to mention that the institutional, private and social actors that will make up the commission are: national institutions, regional institutions, social actors and private actors. The main function of the Ranchería River Guardian Commission is the creation of the design of the Action Plan that will last 10 years.
