The news became known after the Superior Court of Justice of La Rioja rejected the magistrate’s resignation.

For the prosecution, “the behavior that the judge faces is having requested a contribution abusing the exercise of their duties“, González Aguirre mentioned to TN.

“There is a principle of evidence provided by the complainant, in audio and video format that supports what she stated. These circumstances, analyzed by the prosecution, determined sufficient elements for the investigating judge to investigate the case,” the prosecutor added.

According to him, the penalty for this crime is one to four years in prison.

In this context, Abate de Mazzuchelli is accused of the crime framed in article 266 of the Penal Code, which establishes that “a public official who, abusing his position, requests, demands or causes to be paid or improperly delivered, by himself or through an intermediary, a contribution, a right or a gift or collects greater rights than those that correspond.

The investigator mentioned that they had already analyzed the statements and that “it can be seen that there is a precise and consistent story.” This is why the prosecutor’s office “requested protective measures to safeguard the physical and mental health of the complainant.”
