Córdoba City Council rejects a machinery contract due to an error

A mistake has forced the City Council of Córdoba to withdraw from the contract for the supply of three compact motor vehicles for work in the Infrastructure Delegation. There was already a company proposed for the award, Metalúrgica Andaluza de Maquinaria de Obras Públicas SLU, but said error “may have affected the presentation of offers, limiting competition”, so the City Council could re-tender it.

The contract was put out to tender for an amount that amounted to 629,318 euros, divided into several lots. The error, specifically, was detected in lot 2, and referred to the supply of “three compact combustion engine/LPG vehicles with a power equal to or greater than 80 HP in technical and administrative conditions for circulation.”

Once the tender notice was published and the deadline for submitting offers had ended, the entity Metalúrgica Andaluza de Maquinaria de Obras Públicas SLU was proposed as the winner of lot 2, from which documentation was required. But, after analyzing the technical specifications document, it has been observed that an error has occurred in the data included in one of the technical characteristics, specifically where it is indicated “LPG tank with minimum capacity of 60 liters“, using the word minimum by mistake when maximum should have been indicated. Thus, none of the supplies presented by the bidders meet the requested technical requirement regarding capacity.

Finally, the Contracting Committee understands that the existence of the “non-correctable” error in the technical characteristics “could have limited attendance“, proposing that the Local Government Board adopt an agreement to withdraw from lot 2.
