The ruling, handed down by the judge Reinaldo Rodriguezoccurred within the framework of a case that was processed in the judicial system that governed the federal Justice system until May 6, when the accusatory model was implemented throughout the province.

The three merchants were identified as Cecilia B. and Nidia B., both owners of a business located at JJPaso at 3500, in front of the Colón club; and Maria Teresa B.owner of a store in Aristóbulo del Valle at 6500. The judge declared them alleged perpetrators of the crime of marketing of products with registered, counterfeit or fraudulently imitated brands, contemplated in law 22,362.

The now “old” courts will operate in parallel to the adversarial system with the cases they have in process.

The resolution also imposed a seizure of $5,000,000 on each of them and, in the event of a change of address, reporting the modification to Federal Court No. 1, where the case that arose in 2023 is being investigated.

Trout and complaint t-shirts

The beginning of the investigation arose from a complaint promoted by the KDY brand that manufactures Colón and Unión t-shirts and which accused the existence of two stores where counterfeit or imitated clothing was sold.

The complaint fell in turn to the Federal Prosecutor’s Office No. 1, in charge of Gustavo Onelwhich delegated the investigation to the National Gendarmerie, whose personnel raided the commercial establishments on December 1, 2023.

From the JJPaso Avenue store, investigators seized a total of 701 items of clothing (t-shirts, tank tops, sweatshirts, T-shirts and shorts, among others) with the brand’s print; while from the Aristóbulo del Valle location, the researchers obtained 716.

Placed at the disposal of Justice, part of the clothing was sent to an examination carried out by the Federal Police of Rosario and which, after an examination, concluded that all of the seized clothing was apocryphal.

According to the report, the shirts (and the rest of the clothing) had irregular and uneven seams. The logo, in turn, consisted of “irregular figures and legends,” while the embroidery had fragments of fabric and presented anomalies around the isologo.

After learning the results of the investigation, Judge Rodríguez (at the request of the Prosecutor’s Office) investigated the three merchants last March and made them aware of the charges for which they were being investigated in the federal courts.
