Taking into account the situation of risk and danger of a mass removal as a result of the sinkhole that was generated on Sunday, June 9 due to intense rains and that could affect the structural stability of the Euromarina II building, eventually causing its collapse and collapse, Indication of the Municipal Works Directorate, the uninhabitable property located on Las Perlas Street No. 1855 was decreed.

Therefore, the building must be vacated as soon as possible, and the DOM must notify its occupants by delivering a decree to its occupants. This declaration of uninhabitability will remain in force until the conditions of public use space that allow its accessibility are reestablished.

The DOM’s request is based on two reports issued by the SERVIU Valparaíso Region, in which it is stated (Official Letter No. 001) that given the latent risk of collapse on the part of the Euromarina II building, the terrace of the building has presented minor drops. , which are constantly monitored and which, if their increase continues, could affect the structure of the property. “By virtue of this, and also considering that the building currently lacks a functional system for the evacuation of sewage and drinking water, essential services for its habitability, we request that you consider the declaration of uninhabitability for the Euromarina II building from tower one to five.”

The SERVIU letter was accompanied by a Technical Report called “Measurements of registration points”, which aims to report on measurements that have been carried out in the Euromarina II building, indicating that its purpose is to verify whether the structure of the building presents decreases compared to the situation in which it was prior to the frontal system that occurred since last Wednesday, June 12.

Then, through official letter No. 1442 of June 17, from the Ministerial Secretariat of Housing and Urban Planning Region of Valparaíso, hierarchical superior in technical matters of the director of Municipal Works, has indicated, after referring to the SERVIU technical report that reports of declines in various points of the structure of the Euromarina II building, which “in that context, and in light of the conclusions of said report, it is necessary that you, following a substantiated report from the Municipal Works Directorate, urgently technically evaluate the application of Article 161 bis of the General Law of Urban Planning and Construction”.

The conditions described above constituted a threat of risk and danger, due to a possible mass removal event that, if it materialized, due to its special location, could completely affect the structural stability of the Euromarina II building, eventually causing its collapse and collapse.

For this reason, and in compliance with letter i) of article 4 of the Constitutional Organic Law of Municipalities, the Municipality notified the National Disaster Prevention and Response Service and the National Geology and Mining Service, to consult, among others matters, by the protocol indicated in article No. 50 of law No. 21,364 and No. 4 of its regulations and by the other measures that have been adopted in this regard, by virtue of this mass removal event.

Taking into account everything described above, given the serious risk to the structure of the building and, for the safety of its owners and occupants, through memorandum No. 56 from the mayor of Viña del Mar, addressed to the Director of Municipal Works, it was requested , as an urgent matter, its statement regarding the relevance of applying article 161 bis of the General Law of Urban Planning and Construction, that is, the eventual uninhabitability of the Euromarina II building and any other building in the sector that may be affected by this statement.

In the main, the statement of the Director of Municipal Works suggests the application of article No. 161 bis of the General Law of Urban Planning and Construction, namely “taking into account the previously mentioned technical standards and the reports of the public organizations already indicated, those that account for potential structural damage to the building, added to the fact that the property is located within the mass removal security perimeter, and the notorious fact that there is a sinkhole that is active and capable of generating a very serious risk to the life and physical integrity of people, in accordance with the provisions of article No. 38 letter d) of Law No. 21,364, in addition to the fact that said property currently lacks a functional system for the evacuation of sewage and drinking water , essential services for its habitability, we consider it appropriate to issue this report in accordance with article 161 bis LGUC, so that if it is deemed appropriate, declare the Euromarina II Building uninhabitable, for not offering adequate safety conditions for the occupants of the households”.
