The project of labour reform promoted by the Government of Gustavo Petro passed its first debate of four in the Congress of the Republic before the end of the current legislature. The initiative proposes a series of changes for workers, compared to the current scheme.

Workers’ salaries will increase due to labor reform

One of the most important changes approved is the redefinition of the daytime shift, which now extends from 6:00 a.m. to 7:00 p.m. m. Any work done outside of these hours will be considered night work and, therefore, subject to additional charges.

This represents a notable change, since previously the daytime It lasted until 9:00 p.m. This adjustment will benefit employeeswho will have the right to receive additional payment for work carried out at night or overtime.

A nightly surcharge is worth $7,630 per hour; one Sunday or holiday, $11,870 per hour; one hour of extra night, $9,891; and an extra hour on Sunday or holidays at night, $14,130.

The reform also establishes a gradual increase in surcharges for work on holidays and Sundays. Currently, these surcharges correspond to 75% of the minimum daily wage, but with the new regulations, this percentage will increase:

  • Starting July 2024: the surcharge will be 80%.
  • Starting July 2025: the surcharge will be 90%.
  • Starting July 2026: the surcharge will reach 100%.

Of course, it is key to clarify that these changes will come into effect only if the labor reform passes the three remaining debates in the Congress of the Republic.

Labor reform increased compensation for dismissals without just cause

The compensation for a worker with a fixed-term contract is currently 15 days. Due to the labor reform, it will be 30 days.

For people who They have an indefinite term contract and are fired without just cause, this is how the calculations will be:

  • If the person worked less than a year, they will be pay 45 days.
