Cristian Nieva expanded his statement as a defendant and denied having caused the fatal injury to José “Pelado” Leiva. He did it today, in the Attorney General’s Office building.

In the procedural act, he was assisted by his defense lawyer, Gabriel Díaz.

On the occasion, Nieva was again in front of the Prosecutor of Instruction No. 1, Yésica Miranda, who is investigating the event. The investigation began at 8:30 and lasted until after 11.

In addition to testifying, Nieva answered some questions that the investigators asked him.

“Nieva has given her version of the events. He has denied in all his terms that he was the one who caused the injury that caused Leiva’s death. He has absolutely nothing to do with the outcome of this event. “He has given some details and clarifications that are already known to the prosecutor,” said Díaz in dialogue with the press.

The lawyer pointed out that his assistant made a chronology of what he did on the day of the incident “from the moment he became aware that they were trying to damage his car and try to steal it. He has made a chronology of what it was like to get to the place, all those issues.”

Díaz stressed that the defense allowed the investigators to ask “everything they have to ask.”

“Mr. Nieva has answered all the questions. “We have also raised some questions in order to further clarify and give strength to the veracity of Mr. Cristian Nieva’s statements,” he added.

According to what the defender indicated, the elements in the case “give strength and veracity to Cristian Nieva’s statements and version.”

Cause

The incident that involved Leiva occurred on Tuesday, March 12 of this year around 4 o’clock in the Cristo Rey neighborhood, in the Capital city, where the individual tried to open the trunk of a vehicle.

This circumstance was noticed by the owner of the vehicle and the neighbors, who went out in search of the suspect whom they managed to intercept and subjected him to a beating.

Leiva was admitted to the San Juan Bautista Hospital (HSJB) from that day until Tuesday, April 9, when his death occurred.

In this event, for the Prosecutor’s Office, Nieva hit Leiva with a crowbar; and Manuel Hernán Coronel and Fabricio Rodrigo Luján also attacked the victim.

For this, prosecutor Miranda charged the three subjects: Nieva, with the crime of “simple homicide with possible intent” and Coronel and Luján with the crime of “minor injuries classified as treachery.”
