The request that the radio concessionaires stop transmitting La Hora Nacional during the electoral campaign period did not proceed. The Complaints and Reports Commission of the National Electoral Institute (INE) rejected the matter presented by PAN legislators Federico Döring and Luis Alberto Mendoza due to the comments their hosts made about the candidate Claudia Sheinbaum.

However, the matter will be analyzed in depth by the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), a body that can determine if there would be a sanction to the concessionaires for the transmission of the broadcasts of December 3 and 10, 2023 and January 14. of this year, where the drivers made comments about the standard bearer of Let’s keep making history.

Without opening the discussion, the three councilors who make up said commission (Claudia Zavala, Arturo Castillo and Rita López) voted on this point of the session, declaring the complaint of the PAN deputies inadmissible, stating that stopping broadcasting this program “would constitute a disproportionate restriction on the maximum freedom of expression that under the appearance of good law is not considered intrinsically illegal.”

It was noted that as long as the constitutional and legal limits provided for in government propaganda in the campaign stage are respected at present and in the future, there is no reason to stop the broadcast of a program.

They recalled that in the session of February 28, the producers of La Hora Nacional and the radio and television concessionaires were ordered to refrain from holding demonstrations that could be illegal during the campaign period, so on that occasion precautionary measures were issued regarding to the General Directorate of Radio, Television, and Cinematography and the National Polytechnic Institute, as well as Javier Ramírez Gómez and Leonora Milan Fé.

However, the request to stop broadcasting this government program every Sunday did not proceed.

On the other hand, this commission ordered the governor of Nuevo León, Samuel García, to avoid comments linked to electoral issues, because as a public servant he cannot make expressions or express opinions that seek to support the candidate for the presidency of the Republic of his party. .

Counselor Claudia Zavala pointed out that the governor published on his social networks an event together with Dante Delgado, national leader of the Citizen Movement (MC) “and his friend Jorge Álvarez Máynez, who met with ambassadors of the European Union.”

“Article 134 of the Constitution imposes a duty of neutrality on all public servants, so they cannot interfere in favor of a candidate,” the counselor reiterated to the governor of Nuevo León.

He said that the state leader does refer to the other contenders and should not do so. “There is content on electoral matters and it is not allowed and from my point of view the dissemination of this message should not be allowed.”

Councilors Rita Bell López and Arturo Castillo agreed on this, who pointed out that the publication of that video does violate the principles of equity and neutrality in the contest, because Samuel García is a governor “and he is spreading something that “It refers to positive aspects of his political party,” said Castillo.

While Counselor López added that the video also identifies a presidential candidate and says that “the old politics”, which alludes to phrases used by the current MC candidate and as governor he cannot do that.
