The Court of Appeals of Rancagua declared the request of the Public Ministry for Extradit from Peru to Wacris Ricardo Cabarcas PiñaVenezuelan citizen syndicated as the leader of a local faction of the Aragua Train and accused of aggravated extortive kidnapping, criminal , robbery with violence and subtraction of minors. The crimes would have been committed in February 2024 in the commune of Las Cabras.

The First Chamber of the Court, made up of Minister Michel González, the judicial prosecutor Andrea Alfaro de la Fuente and the lawyer (I) Paloma Valenzuela, issued a unanimous ruling. In it, it was confirmed that the Case meets the requirements of the Extradition Treaty between Chile and Peru, signed in 1932 and ratified in 1936.

The text of the ruling quotes: “The high contracting are obliged to reciprocally surrender the criminals of any nationality, refugees in the respective territories or in transit by these, provided that the requesting country has jurisdiction to judge the infraction.” This legal framework supports the request of the Public Ministry.

Charged in Lima

According to the court, Cabarcas Piña is held in Lima, Peru. This was confirmed by Office number 5896-2025. “The accused is currently in the city of Lima, Republic of Peru, with deprivation of liberty,” details the resolution.

The ruling also stressed that imputed crimes exceed the minimum penalty required for extradition. Among them, the aggravated extortion kidnapping (article 141 of the Criminal Code); theft with violence (article 432); Criminal Association (Article 293) and subtraction of minors (Article 142 No. 1). The sorrows in the abstract for these crimes start from the age of five and one in prison.

In addition, the Court supported the accused prior detention request while extradition is processed. He argued that “the guarantee judge verified the concurrence of the legal requirements to decree preventive detention”, in line with articles 434 and 442 of the Criminal Procedure Code.

Diplomatic steps

The Court ordered notifying the Ministry of Foreign Affairs to manage extradition and previous detention. “OFFICE TO THE MINISTRY (…) To make Peru the necessary diplomatic efforts,” says the document.

Cabarcas Piña was formalized on April 21, 2025 before the Court of Letters, and guarantee of Peumo. The resolution emphasizes that Chile has jurisdiction to judge crimes, since they occurred in their territory.

The ruling concludes that all the requirements of the treaty are met, including the double incrimination and severity of the penalties.
