The Court has reserved three sessions: this Tuesday at 09:30, local time, and at 2:00 p.m., and Wednesday at 09:30.
The STF charged in total 14 people who will respond for the crimes of organizing misinformation actions to disseminate false news about the electoral process and virtual attacks on institutions and authorities.
The group is also investigated for the improper use of the Brazilian Intelligence Agency (ABIN), for illegal purposes, configuring an escalation of the state apparatus for coup leaders.
The Chamber examines at this stage if the complaint meets the legal requirements and evaluates whether the accusation presented sufficient elements to open a punitive action against each of the accused.
As happened in the trial against former president Jair Bolsonaro, the Supreme Court must increase police surveillance and restrict access to the facilities in the days of the sessions.
In total 34 people were incriminated by the Federal Public Ministry at the violent plot to hinder the arrival of President Luiz Inacio Lula da Silva after defeating Bolsonaro in the polls in 2022, but the Superior Court divided the trial into four groups. By May 20 and 21, the panel will analyze the charges presented against another 12 members of the so -called Core Tres, composed of 11 active military and Army Reserve, and a Federal Police.
The expectation is that the analysis of the axis four represents another step forward in the process of legally holding those involved in the attack on national democracy.
If the charges are accepted, the defendants will face a criminal process in the STF, in which evidence will be collected, witnesses will be heard and the arguments of the defense and the accusation will be presented before the final sentence.
The analysis is considered emblematic because it involves public agents, military personnel and state structures, such as Abin, in a coordinated attempt to subvert order.
The session will be held in the midst of a growing pressure of civil society and institutions so that those who were involved in coup d’etat attempts and attacks on the institutions yield accounts in an exemplary way.
The trial could become a legal and political milestone in the confrontation of antidemocratic episodes in Brazil.
