Witnesses rebuilt the night of Christmas Eve crime 2019

In the Criminal Court one of Posadas this morning continued with testimonies and exhibition of evidence the oral debate against Ramón Barboza (69), who is on the bench of accused for killing his stepdaughter of two stabbed at the good night dinner of 2019.

In total, five witnesses were presented – 4 face -to -face and one via zoom – who answered the questions of the Prosecutor’s Office, by the prosecutor Vladimir Glinka (by subrogation), and defenders Florencia Cáceres and Jorge Cáceres.

Meanwhile, the first witness was Luis Drewans, a police officer who went to Barboza’s domicile on the night of December 24, after a 911 call that alerted Alejandro Casburg’s attack.

In his testimony he explained the procedure that had to perform that night, telling that after addressing the home and becoming aware of what happened, he toured through different streets and could see the car in which Barboza fled his home. “The car was in motion, when you see the lights on, she got into a street” explained the witness, adding that when they reached him, they asked him to descend from the vehicle to take it.

Then he gave his testimony María Ester Barboza, sister of the accused, who remembered details of that Christmas Eve dinner.

“Ramón promised my mother that she was going to dinner, because in his house was Clara’s son -he drunk and exalted, in addition to every year we visit mom because she is already big” the woman told, adding that the promise was about 8 pm.

In that line, he mentioned that it was 22 hours when the mother insisted asking where Ramón was, so he went to his house to see what had happened. “When I arrived there was no ambulance, just a black car standing in front of my brother’s house. In the car was a lady shouting and a lying boy lying, moaning,” he recalled. “Clara did not want to get into the car and by instinct I went up. The car had a lot of smell of drink,” added the woman.

In relation to the victim’s transfer to the Madariaga hospital, María Ester said that the vehicle in which they were “first did not bend down the hospital street, went down the waterfront and took a long time”, in addition to mentioning that “when we arrived at the hospital I asked them please take him inside, because he was very bleeding.”

False testimony

An issue that stood out in his testimony is that he mentioned that when he went to the hospital, the car in which they were stopped in the traffic lights, something that the prosecutor considered that it was a testimony that was exposed to benefit the accused by simple homicide and that does not coincide with what was said by the driver of the car that was presented as a witness yesterday, in the first day of the trial. Therefore, Ginkka requested that the investigation be carried out for false testimony.

Meanwhile, after the testimony of the suspect’s sister, another policeman who appeared to the domicile of the accused was presented as a witness, where the crime occurred and in the place where the Barboza vehicle was.

For its part, the witness said that the element with which the defendant would have used to kill his stepson, in areas surrounding the house, but that he could not be found.

The last person who appeared in person as a witness was Teresa – another of the defendant’s sisters – who was also in the mother’s house, waiting for Ramón to arrive to receive Christmas.

In his story, he said that when he accompanied the police to the place where they were stopping Barboza, they asked her to take her two dogs that were inside the vehicle. As she was with a cane and it was difficult to take them, she mentioned that an officer told her to take the dogs with the car.

According to his story, that was what he did, leaving the shot at his mother’s house to continue dinner -without knowing the reason why his brother was arrested, but without giving the mother the mother for her age.

Finally, he mentioned that he only knew the victim of Vista and that he could not ensure if he was alcoholized or drugged. Details mentioned by the accused himself in his statement before the court.

The last of the witnesses was the police doctor Juárez, who examined the victim and determined two white weapon injuries in Alejandro’s body -one in the arm and another in the abdomen. In his testimony he explained that with these injuries they can have the possibility of saving, but that many circumstances have to do to achieve it.

After this testimony, the oral debate entered an intermediate room until 8:30 on Friday. The allegations of the parties are expected to be presented and the sentence by the Court composed of Viviana Cukla (President) and the Vocals Gustavo Bernie and Miguel Mattos (by subrogation) will be ruled.
