This Saturday it takes place the Public Account 2024, by President Gabriel Boric. In his speech, the President announced that this year they will introduce a bill, to increase penalties to those who collude.

“Recently the FNE released a serious case of collusion between companies that provided medical gas to hospitals in the middle of the pandemic. In good time we have a robust institutional framework that discovered the trap and brought it to justice. Just as we did with the economic crimes lawthis year we will enter a project to increase the chances of those who collude end up in jailwhich is where they belong,” said Boric.

And he added that “for our government no one is above the law and these cases cannot go unpunished.”

The mandatary did not provide details nor dates of the project that he announced in the face of collusion in his third speech on June 1.

At the beginning of May, the National Economic Prosecutor’s Office (FNE) denounced Indura and Linde for collusion in the industrial and medicinal gases market. The organization presented a request before the Court for the Defense of Free Competition (TDLC) against both companies and three of their executives. However, he asked to fine Indura and its general manager and exempt Linde from the accusation, a company that availed itself of the compensated denunciation.

The FNE accused that the cartel had a general reach in the industrial gases marketmedicinal and special, without any type of distinction, which is why it affected clients with plants on-sitewho supply in bulk and who buy cylinders, in industries such as metallurgypaper, forestry, construction, aquaculture, food, laboratories, mining, oil refinery, steel, glass and medicinal, among others.
