“Gas companies have the obligation to compensate in subsequent invoices”

After the presentation of the protection by the Provincial Government in Caleta Olivia, which resulted in the precautionary measure in favor of the northern area of ​​Santa Cruz, on Tuesday it was learned that the Federal Court of Río Gallegos issued the precautionary measure that repeals the rate increases for the south of the province.

In this regard, the State Prosecutor, Dr. Lucio de la Vega, spoke with The mediatora program that is broadcast on Weather FM 97.5, about this ruling: “It seems to us that this ruling is very tight, it replicates the Caleta Olivia ruling, it contemplates the arguments that we presented in the collective protection. The increase is disproportionate with percentages ranging from 400% in April and in the winter period the bill was going to reach 800%,” he said.

“Until yesterday, only those in the Northern Zone were reached, it will be from April 2, for six months, this is because the measure is required to have a certain temporary validity, then eventually an extension could be requested. “At least it covers until the end of the year,” the lawyer added.

Likewise, he specified: “The national state can appeal because it is part, in Caleta Olivia the precautionary measure was notified in ENARGAS, we are waiting for it to also happen in the South Zone. Although the gas companies are not part of the protection, we must see the position they take.”

Regarding the increase, he assured: “This measure sets a limit of 300% increasewhich is high, but this precautionary measure sets a limit, now the national government must respond to the demand.”

“The two rulings establish the same thing, that gas companies have the obligation to compensate in subsequent invoices increases that have been invoiced in excess of 300%. This is up to the gas companies to adapt to this ruling, with compensation, it is an obligation of the companies for the bills that come,” he clarified.

Finally, he mentioned the increases in the gas rate, specifying: “There will be an increase with a cap of 300% and the bills that are arriving have part of the old rate from the previous year, others have a new rate and we have to work.”
