According to prosecutor Andrés Azar in the theory of the case that he gave at Tuesday’s hearing, the cause that led to the incident was the reckless and illegal action of the woman – identified as ILP-, “who should have given way, because he was the one who had to make a turn to enter another road, on which the victim was already traveling.”
Azar stated that the motorcyclist was transferred to the Castro Rendón Hospital, where he received the first care and the first surgical intervention, and then was transferred to a private clinic, where he remained in intensive care and required another operation. Fortunately, the motorcyclist survived.
For all this, the prosecution framed what happened in the crime of serious negligent injuries, caused by the reckless driving of a motor vehicle, as the author.
After listening to the parties, the guarantee judge Gustavo Ravizzoli considered the charges formulated and set the investigation period at 4 months.

The theory of the case that Gutiérrez detailed occurred on January 28, around 11:30, on the corner of Fortineras and Mendoza streets of that city. “CES” – as the accused was identified – was traveling in a truck through Fortineras towards the South, when at the intersection he was hit on the passenger side by a motorcycle that was traveling on Mendoza Street. The motorcyclist was injured in the crash.
Within the framework of the investigation of the incident, an accident report was carried out that determined that the person who caused the crash “as a consequence of his reckless and illegal actions” was the driver of the truck, given that the accused faced the direct intersection when he had to give way. the passage to the motorcycle that was traveling on his right. Thus, by not stopping his march, he caused the accident.
After the crash, the driver of the motorcycle was taken to the Horacio Heller Hospital in the provincial capital, where the seriousness of his injuries was confirmed.
