The Ombudsman, Claudia Bard, has filed an amparo action before the Rawson Federal Court to suspend the application of the new tariff schedule established by resolutions 41/2024 and 122/2024 of the National Energy Secretariat and ENARGAS. This measure responds to the significant increase in gas rates that affects citizens of various locations in the province of Chubut.

Excessive Rate Increase
Claudia Bard reported that, according to the queries received at the ombudsman’s office, increases in gas service rates range between 400% and 4000% compared to the same measurement period of the previous year. “The level of consumption is similar, however, the rate increase in percentage is disproportionate for the user who must face gas bills in winter that violate the principles of reasonableness, predictability and, above all, gradualness,” explained Bard.

Community Collaboration and Support
The presentation of the amparo had the support of the Puerto Madryn Chamber of Commerce, Consumer Defense, various municipalities and unions such as ATECH. These organizations collaborated in collecting documentation that demonstrates the impact of rate increases in the province, both in the residential and commercial categories.

Application to Camuzzi Gas del Sur
The legal appeal also requests that Camuzzi Gas del Sur refrain from charging or cutting off the service supply due to non-payment of invoices that include the new tariff schedule. This request is based on the need to ensure access to the essential public heating service, especially crucial in the climatic conditions of Patagonia.

Climate Context and Right to Public Service
“Due to the climatic conditions of Patagonia, the demand for gas in Chubut is important and we must defend the right to access the public service that allows heating,” said Bard. The defender stressed the importance of this service in a region where winter temperatures can be extreme, putting the health and well-being of residents at risk.

Rate Increase History
This conflict is not isolated; Historically, rate increases in public services have been a source of dispute in Patagonia, a region with high energy needs due to its harsh climate. In previous years, similar protections have already been presented that seek to protect consumers from disproportionate increases that affect their family finances.

Controversial Resolutions
Resolutions 41/2024 and 122/2024, issued by the National Energy Secretariat and ENARGAS, introduced significant changes to the gas tariff structure. These measures have been justified by national authorities as necessary to adapt costs to the reality of the energy market. However, the impact on consumers has been considerable, causing strong rejection in several provinces in the south of the country.

The amparo action presented by Claudia Bard reflects the concern of the citizens of Chubut regarding the high rate increases in the gas service. In a context of adverse climate conditions and significant energy needs, defending access to essential public services becomes crucial.
