HAVING SEEN Files No. EX-2024-05198131- -APN-DGPPYP#FAA and No. EX-2024-37977004- -APN-DGDA#MEC and Decree No. 1344 of October 4, 2007 and its amendments, by which approves the Regulation of Law No. 24,156 on Financial Administration and Control Systems of the National Public Sector, and
CONSIDERING:
That the ARGENTINE AIR FORCE has generated the BAPIN project No. 107,799 for the incorporation of multirole fighter aircraft to recover the capacity for aerospace operations in the VI AIR BRIGADE – TANDIL PROV. BS.AS.
That the purpose of the aforementioned Project is the incorporation into the aforementioned Force of a weapons system with supersonic capacity, taking into account that the ARGENTINE REPUBLIC requires, due to its large territorial extension and maritime coastline, a National Defense System with immediate reaction capacity and sufficient range to the reaction to threats that move through aerospace.
That the ARGENTINE AIR FORCE has carried out a process of analysis and selection of different aircraft and concluded that the F-16 Weapon System, Fighting Falcon, and the proposal formulated by the competent body of the KINGDOM OF DENMARK constitute the best solution for the Military Instrument Argentinian.
That, consequently, the respective contract was projected between the MINISTRY OF DEFENSE and the PROCUREMENT AND LOGISTICS ORGANIZATION OF THE DANISH MINISTRY OF DEFENSE (DALO) for the acquisition of the F-16 Fighting Falcon Weapon System, which includes SIXTEEN (16) Single-seat aircraft, EIGHT (8) two-seat aircraft, components and services.
That the total price of the contract was set in UNITED STATES DOLLARS THREE HUNDRED ONE MILLION TWO HUNDRED THOUSAND (USD 301,200,000) to be paid in FIVE (5) annual installments.
That the GENERAL DIRECTORATE OF PLANS, PROGRAMS AND BUDGET of the ARGENTINE AIR FORCE has taken the intervention of its jurisdiction.
That the competent technical organizations of the MINISTRY OF FOREIGN AFFAIRS, INTERNATIONAL TRADE AND WORSHIP and the MINISTRY OF ECONOMY have taken action.
That the pertinent permanent legal services have taken the intervention of their competence.
That this measure is issued in use of the powers conferred by article 100, paragraphs 1 and 2 of the NATIONAL CONSTITUTION and by article 35, paragraph b) and its Annex to the Regulation of the Law of Financial Administration and Financial Systems. National Public Sector Control No. 24,156 and its amendments, approved by Decree No. 1344/07 and its amendments.
Thus,
THE CHIEF OF THE CABINET OF MINISTERS
DECIDE:
ARTICLE 1.- Approve the expense derived from the Contract between the MINISTRY OF DEFENSE and the PROCUREMENT AND LOGISTICS ORGANIZATION OF THE DANISH MINISTRY OF DEFENSE for the acquisition of the F-16 Weapons System, which includes SIXTEEN (16) single-seat aircraft, EIGHT (8) Two-seat aircraft, components and services, for a total amount of THREE HUNDRED ONE MILLION TWO HUNDRED THOUSAND UNITED STATES DOLLARS (USD 301,200,000) to be paid in FIVE (5) annual installments.
ARTICLE 2.- The expense approved in article 1 of this measure will be attributed to Jurisdiction 45 – MINISTRY OF DEFENSE, Subjurisdiction 23 – GENERAL STAFF OF THE ARGENTINE AIR FORCE.
ARTICLE 3.- Communicate, publish, give to the NATIONAL DIRECTORATE OF THE OFFICIAL REGISTRATION and archive it.
