The Constitutional court reiterated that the National Electoral Council (CNE) is competent to investigate the electoral campaign of today’s president Gustavo Petro.

The conclusion was reached by solving a conflict of jurisdictions elevated by the Courts 21 Administrative and 29 Civil, both in Bogotá, who received a popular action from the NGO Military, Police, Families, Friends, Honor, Together for Colombia (Mipofaamcol).

Mipofaamcol filed a legal appeal to investigate alleged irregularities in the campaign that led Petro to win the 2022 elections with more than 11 million votes. The above, with a view to determining a supposed violation of funding caps.

The 21st Administrative Court assured that could respond to popular action because the presidential campaign would have incurred a fact generating an alleged violation of rightswhile the civil 29th highlighted the competence of the Electoral Council.

As the process was hampered by the conflict of jurisdictions, the Constitutional Court had to intervene. His determination was that CNE has “preferential” jurisdiction to investigate the alleged irregularities in the campaign.

The statement adds to a order of the Council of State that on May 20 decided that the CNE can investigate the money that went into the campaign presidential, but cannot impose sanctions that remove the head of state from office.

This implies that if the CNE finds irregularities in the reports of Petro’s campaign and the Historical Pact, As pointed out in a presentation by Álvaro Hernán Prada and Benjamín Ortiz, The findings must be sent to the Impeachment Commission of the House of Representatives.

Congress will be in charge of issuing some type of political sanction against the president, according to the order signed by the Judge Omar Barreto in response to a lawsuit from retired Army Sergeant José Ángel Espinosa.
