In the midst of the commotion that the community of the tourist city of Villa La Angosturaprovince of Neuquén, by The tragic car crash that occurred on National Route 40in which two brothers, Lisandro (29) and Exequiel Linares (31), and their children Tahiel (12) and Martina (6) died., the investigations carried out by personnel from the provincial Scientific and Criminal Police showed that the truck driver “created an impermissible risk” by crossing lanes in an area “with a double yellow line on the road.” Given this scenario, the Dr. Adrián de Lillothe prosecutor in charge of the investigation, requested the preventive detention of the truck driver, but the Judge Bibiana Ojeda did not grant said request and, instead, ordered the prohibition of the accused from leaving the country.

According to the judicial sources consulted by Infobaethe Lillo prosecutor attributed the driver of the cargo truck, identified as Carlos Artur De Peder Da Silva, Brazilian, 53 years oldhaving caused the death of four people, after considering that he carried out a “reckless and illegal” maneuver which caused the tragic accident on RN 40, one kilometer from the junction with provincial route 237.

“The collision occurred in circumstances in which DS (Da Silva) created an impermissible risk when he maneuvered in an illegal manner by not respecting traffic signs, and disobeying the mandatory double yellow line horizontal marking existing on the road whose meaning is the prohibition of crossing lanes and carried out a maneuver to his left, generating his entry into the opposite lane of Route 40, thus invading the circulation space of the Fiat Strada model vehicle, which was circulating in the direction contrary,” said Lillo’s prosecutor at the imputation hearing.

As this media was able to find out, the alcohol test to which the truck driver was subjected gave results negative.

Lisandro (29) and Exequiel Linares (31), and their children Tahiel (12) and Martina (6).

Because Da Silva did not provide an identifiable address during his statement, and in order to guarantee submission to the rigorous judicial process, Dr. De Lillo requested that he be detained preventively. However, Dr. Ojeda, who was in charge of the hearing, did not accept the prosecutor’s proposal but did issue a prohibition on leaving the country and He ordered the accused to establish an address in the city of San Carlos de Barilochewhere you must appear daily at a local police station.

After recounting his hypothesis of the case, prosecutor De Lillo framed the accusation in the crime of manslaughter, caused by the reckless driving of a motor vehicle, aggravated by the number of fatalities.

To support the accusation, the representative of the Neuquén Public Prosecutor’s Office highlighted the plurality of victims and the status of the accused as a professional driver. And because this is a defendant of another nationality who has no roots or residence in the country, he formalized before the magistrate the request for preventive detention for the truck driver.

Judge Ojeda considered the charges formulated and He set the investigation period at four months. At the end of this period, the accusation control must be carried out, to then set the date of the trial to which the accused will be subjected.
