AMIA Case: The Inter-American Court of Human Rights condemned the Argentine State

This Friday, the Inter-American Court of Human Rights condemned Argentina in the case of the AMIA attack. Unanimously, it declared the Argentine State responsible for violating the human rights of the victims of the attack against the Jewish mutual fund on July 18, 1994.

The international court ratified a previous conviction and added the violations to the “collective right to the truth.” It ruled, meanwhile, that the Argentine State “must commit to investigations and reparation measures.”

The ruling forces Argentina to formulate “structural reforms on the use of intelligence information in judicial cases and on access to documentation.”

The Inter-American Court granted the claim made by the group of victims and relatives Memoria Activa, with the sponsorship of the Center for Legal and Social Studies (CELS).

“State authorities cannot rely on mechanisms such as state secrecy or confidentiality of information, or on reasons of public interest or national security, to stop providing the information required by the judicial or administrative authorities in charge of the investigation or pending processes,” the ruling states.

In that sense, the Inter-American Court affirmed that “the State violated the right of access to information by not having guaranteed real access to the state archives with documentation about the attack and the right to the truth by having covered up the attack and hindered its investigation”.

In October 2022, Argentina recognized its international responsibility for the events, in hearings held in Montevideo. The Court valued this recognition and highlighted that it meant “a positive contribution to the development of the process, to the validity of the principles that inspire the Convention and to the satisfaction of the victims’ needs for reparation.”
