Cuba will allow residents abroad to maintain their properties and even inherit

The National Assembly of People’s Power of Cuba has presented a new legislative project that includes specific provisions for Cubans residing abroad. They emphasize the right to keep their property or inherit, regardless of how long they remain outside the country.

The new bill clearly establishes that Cubans residing abroad can inherit property in Cuba regardless of how long they have been absent. This change addresses a long-standing concern among the Cuban diaspora, who feared losing their property rights due to prolonged stays outside the country.

The document specifies that, even if Cubans reside abroad for more than 24 months, they can keep inherited properties in Cuba. Automatic loss of property for this reason is not contemplated in the new bill.

To secure the inheritance, heirs must follow the necessary legal and administrative procedures. This includes submitting the relevant documentation to the Cuban authorities to register the inheritance and guarantee ownership of the property.

In addition, heirs are required to comply with all tax obligations associated with the inheritance, such as paying property taxes. Although you do not automatically lose property for being out of the country for more than 24 months, it is crucial to comply with the regulations established by the Cuban government.

Properties must be properly registered, and owners must keep up to date with any administrative requirements.

Effective immigration residence

This bill also eliminates the designation of “migrant” for those who have been outside the country for more than 24 months, introducing the new definition of “effective immigration residence.”

According to the text, this condition is achieved when Cuban citizens and resident foreigners spend most of the previous calendar year in the national territory, or demonstrate significant roots through a combination of permanence and other material evidence.

The update of the 24-month limit, extended since the coronavirus pandemic when many Cubans were unable to return to the island, speaks of the intention to adapt to current realities and facilitate the continuous connection of Cubans abroad with their country of origin. .
