This repeal initiative arises from the little usefulness that the Law has had since its implementation, considering the small number of contracts registered compared to the totality of operations carried out in the agro-industry, and the request from producers and industrialists in the province.

From the Chambers of Commerce, Industry and Agriculture of San Rafael and the Chamber of Commerce, Industry, Agriculture and Livestock of General Alvear they highlighted that “this Law has presented difficulties since its conception by not respecting production times, establishing limits that hinder effective work. . The restrictions imposed do not allow the conclusion of contracts before receiving the raw materials at the industrial establishment, generating uncertainty regarding the quantity and quality of the product. Likewise, setting a definitive price before the availability of the product is unfeasible, since the price depends on demand, turning any prior estimate into mere speculation.”

On the other hand, the Association of Producers, Packers and Exporters of Garlic, Onions and Related Products of the Province of Mendoza (ASOCAMEN) highlighted that the current Law has resulted in multiple inconveniences that negatively affect the sector, emphasizing its “incompatibility with the productive reality, its administrative and bureaucratic burden, inefficiency in pricing, unfair fines and sanctions, and competitive disadvantages.”

For its part, the Chamber of Industrialized Fruit of Mendoza pointed out that the application of Law 9133 “does not benefit any of the parties and generates costs and delays in the agility of commercial operations and that the Law has not met its objectives. , generating higher costs and reducing the competitiveness of Mendoza companies.”

From Bodegas de Argentina they added that since the entry into force of law 9133, “no benefits have been observed for any of the parties, it only penalizes buyers of grapes with severe fines, its implementation is of a high cost for buyers and none For sellers, it does not protect producers and even harms them in the transaction model and rejects the purchase of grapes.” In addition, they stated that it is “necessary to debureaucratize the raw material acquisition processes and that the long-term relationship between producers and wineries must be deepened,” among other points.

Carlos Dávila, from the Chamber of Commerce, Industry and Agriculture of Tunuyán added that “it is necessary to generate a tool that is superior, a qualitative improvement, to strengthen the integration of small and medium producers with the industry. There are clear examples of other activities that have to do, not with viticulture, but with horticulture and fruit growing, where there are many strengths and examples to copy, for example, the issue of Tomato 2000.
