The Court of Appeals of Coyhaique rejected an appeal for annulment filed for a case of homicide and drug trafficking – Radio45Sur.cl

The Court of Appeals of Coyhaique rejected the appeal for annulment presented by the defense of Diego Rubén Avendaño Villaseca, who was sentenced to 13 years in prison for simple homicide. The sentence includes absolute perpetual disqualification from public positions and offices, political rights and tenured professions for the duration of the sentence. This crime was perpetrated on January 29, 2023 in the city of Coyhaique.

In a unanimous ruling (case role 176-2024), the First Chamber of the appeal court, made up of ministers Pedro Castro, José Ignacio Mora and Natalia Rencoret, confirmed the sentence handed down by the Oral Criminal Trial Court of Coyhaique. In addition, Avendaño Villaseca was sentenced to 6 years in prison for drug trafficking, with the same disqualifications and a fine of 40 UTM, for events that occurred on March 13, 2023.

The ruling highlighted that there was no violation of the principle of consistency in the challenged sentence; according to the court, the description of the facts and the conduct of the accused in the tax accusation substantially coincide with those accredited by the court. Thus, the appeal for annulment was rejected, confirming the sentences imposed for homicide and drug trafficking.
