Seniquel is in preventive detention, accused of being the author of homicide qualified by the link since November 2021, confirmed by the Court of Appeals. The public defense tried to prove, until now without sufficient evidence, that the young woman was a victim of gender violence.
The investigation into Diaz’s homicide is being carried out by the Homicide Prosecutor. Ana Laura Gioriaand the victim’s parents are plaintiffs in the case with representation of the lawyer Daniel Rocca.

The homicide
The crime blamed on Seniquel occurred on September 25, 2021, between midnight and three in the morning. The young woman arrived at the home of Ayrton Diaz, in Batalla de Ituzaingó at 4700, aboard a beach-type bicycle; Lourdes and Ayrton had been in a relationship for four years, which had recently ended.
An argument began between the two young people; in a moment, Lourdes attacked him with a sharp object in the neck, states the accusation shared by the Prosecutor’s Office and the complaint. Before leaving the scene, Seniquel started a fire at Díaz’s home: A mattress in the bedroom set on fire, which could not spread due to the arrival of firefighters who managed to put it out.
Díaz’s body was found by his father, lying on the floor, naked, covered with a blanket. The man, whose home was next to that of his son, entered the house when he noticed that there was a fire in the place, after hearing a roar.
It was he who called the police when he saw the young man lying on the floor, and upon arrival the Radio Command personnel noticed that in a room there was a mattress on fire.

The process
Seniquel was arrested and charged with homicide qualified by the link in November of that year, and was remanded in preventive detention. In 2023 the public defense was based on the Cion ruling (a policewoman from San Javier acquitted for the murder of her partner) to maintain that the young woman was a victim of gender violence, and that she had acted in legitimate defense.
However, this position was rejected by the Court, in the first instance and in the Court of Appeals, since there was not enough evidence to support the defensive position: the medical examination carried out on Seniquel after her arrest determined that the young woman had no injuries or pain at the time of the examination, and the testimonies collected in the case reveal the violent acts of the accused towards Ayrton.

The night of the crime, the victim’s father told the police that some neighbors had seen his son’s ex-girlfriend on a bicycle, near the scene, moments before. This was endorsed by several witnesses, and some of them even referred to the violence exercised by Lourdes against Ayrton which they witnessed because they had seen and heard them.
Film records were collected from security cameras from a private home located in Roverano at 2400 Santo Tomé, in which Lourdes Seniquel is seen passing by on the bicycle, around 2:30 on September 25, 2021, which corroborates what the witnesses said.
The investigators then raided Seniquel’s home, and They managed to detect the presence of blood on the bicycle brake, on the seat and on one of the pedals. Also, on the bathroom and anteroom floor of the property. DNA tests made it possible to corroborate that the samples corresponded to the victim.
In relation to the fire in the home, the report from the Technical Area of the Casualties Section of the Sapper Firefighters Group of Santa Fe, determined that the fire source originated in a two-seater mattress in the bedroom, which could have been suffocated if it had not been suffocated. spread throughout the house, and that it had been generated intentionally.

A violent relationship
Regarding the relationship that existed between the accused and the victim, several witnesses maintained that Lourdes was violent with Ayrton: they had seen blows and heard threats from the young woman, both with her boyfriend and with third parties.
A witness also detailed a circumstance for which Ayrton was arrested and charged: Ayrton had bought a gift for his mother and Lourdes, when she found out, grabbed some new sneakers that the victim had and opened them whole with a knife. This caused Ayrton to react aggressively, and Lourdes, together with her mother, because on that date she was a minor, filed a complaint for injuries and unlawful deprivation of liberty against Ayrton.
The boy was charged and regained his freedom on May 31, 2019: he was prohibited from approaching Lourdes, he had to attend the Public Prosecutor’s Office once a week and undergo a workshop on the topic of gender violence given by the Municipality of Santa Fe or Santo Tome. The Prosecutor’s Office collected the pertinent evidence in relation to Díaz’s compliance with all the imposed conditions. Records issued by the 9th UR I Sub-Police Station were also collected, which show that Ayrton’s mother showed up to report Lourdes Seniquel’s attempts to approach her son, days after the ban on contact was issued.
