Five owners of financial companies prosecuted for multiple crimes by the Federal Court and detained for more than two years in preventive detention in the Miraflores prison, began a supposed hunger strike on Wednesday demanding that the Federal Court of Appeals of Tucumán speed up the resolution of several incidents.

Four of them: Esteban Cabello and José Daniel Carrizo, owners of the financial company Beta Investiment SRL (operating under the fantasy name BetaBank); Cristian Sixto David Rojo, owner of Callvu Financial and Stock Market Services and Edgar Bacchiani, founder of Adhemar Capital SRL, were prosecuted by the Federal Judge of Catamarca, Miguel Ángel Contreras.

The fifth inmate is Edgardo Federico Bulacios, a member of the Bulacios-Nieva clan, owner of the company RT Inversiones SRL, who was prosecuted by the judge of Santiago del Estero, Sebastián Argibay. The five jointly sent a letter to the Federal Court of Catamarca to inform about the protest modality, complaining about the excessive judicial delay in the processing of their cases.

The Federal Prosecutor’s Office – which was informed of the complaint regarding yesterday’s publication by this newspaper – acted ex officio and commissioned the Secretary of Enforcement, Natalia Colombo, to interview the five suspects.

For his part, Federal Prosecutor Rafael Vehils Ruiz said that it is the power of the Public Prosecutor’s Office to ensure the state of detention of the accused and inmates who are housed in the prison, whether prosecuted or convicted.

He explained that the delays are due to the fact that the cases are in the Federal Court of Appeals of Tucumán, where various claims by the defendants’ defenses are pending resolution. “The financial cases represent the movement of a Prosecutor’s Office. They are complex cases due to the volume, the investigation and the number of defendants there are,” he added. It was learned that Bacchiani protested because he sent notes to the Provincial Penitentiary Service (SPP) to be delivered to the Court, but received no response.

Their defense attorney, Ezequiel Walther, in conversation with Mañana es Hoy, on Radio Ancasti, explained that the protest is so that “the unjustified delays in specific and concrete issues for each of them are resolved” and that “given that the time is running out, they understood that after so many complaints it was prudent to move forward and take this forceful measure. More than five months have passed with several appeals in Tucumán and complaints made by Bacchiani that have not progressed, in addition to other issues. They are taking longer than necessary and all this was trying the patience of the five detainees,” he added.

“There are currently appeals pending in Tucumán regarding the request to moderate the Bacchiani prison. We hope that the Justice Department brings together wills so that all this can be resolved,” he concluded.

Other judicial sources reported that the five prisoners asked to be dismissed, released from prison or house arrest, and authorized to use cell phones. They also confirmed that the prompt resolution of incidents in various cases is expected in the Tucumán Chamber.
