This July 20, along with the installation of the new legislature, the Congress of the Republic will resume the debates on the Labor Reform, one of the social projects proposed by the government of President Gustavo Petro.

According to the Ministry of Labor, the articles seek to improve the working conditions of working families and give more guarantees to the country’s employees.

That is why one of the sections of the reform talks about the compensation that employees must pay if they dismiss their collaborators without just cause.

If approved, the article indicates that In no case of dismissal will the compensation be less than 45 days of the workers’ salaryHowever, there are other variables that must be taken into account. Here we tell you.

This is how compensation for unjustified dismissal would be, according to the labor reform

The changes proposed by the labor reform depend on the type of employment contract. However, the payment cannot be less than 45 days of salary.

One of the most important points to highlight is that If the worker has more than one year of continuous service and less than five years, he or she will be paid 20 additional days of salary over the basic 45 days.

If the worker has five or more years of continuous service and less than 10 years, he/she must be paid 30 additional days of salary on top of 45 basic days. However, if the worker has 10 or more years of continuous service, he/she will be paid 60 additional days of salary on top of the 45 basic days.

The government project also states that if the employer does not comply with the stipulated compensation, must pay the worker, as compensation, a sum equal to the last daily salary for each day of delay until payment is verified.
