Migueles’ lawyer, Jorge Villalobos, argued that “the legal system necessarily has certain limitations”highlighting that only the Public Prosecutor’s Office and the criminal courts have the power to carry out such investigations, La Tercera reports.

According to the letter, the request from the Ethics Commission “constitutes an unlawful act” and could be considered a crime, since it seeks to access secret information obtained in the context of a criminal proceeding.

The document urges prosecutor Valencia to deny the delivery of the records to the Ethics Commissionarguing that its review would be a “direct transgression” of regulations and constitutional rights.
